Terms of Service – StageScreen

# Terms of Service

These Terms of Service („Terms“) govern your access to and use of the mobile

applications, websites, digital products, subscriptions, in-app purchases, and

related services that link to these Terms (each an „App“ and together the

„Apps“).

By downloading, installing, accessing, purchasing, subscribing to, or using an

App, you agree to these Terms. If you do not agree, do not use the App.

Provider / publisher: NiceoSoft, or the developer, publisher, or company name

shown in the relevant Apple App Store or Google Play listing for the specific

App.

Contact: You can contact us using the support email address shown in the

relevant app-store listing or on the applicable support page for the App.

## 1. Scope of These Terms

These Terms are intended to apply across multiple Apps provided by us. Some Apps

may have additional app-specific terms, feature descriptions, purchase screens,

store listings, documentation, or notices. If app-specific terms conflict with

these general Terms, the app-specific terms apply only to that specific App.

The Apps may be distributed through platforms such as Apple App Store and Google

Play. Your use of those platforms is also subject to their own terms, policies,

billing rules, refund processes, and usage rules.

## 2. What Our Apps Do

Our Apps may provide productivity, event, presentation, utility, creative,

subscription-based, or other digital features. The exact features of each App

are described in the relevant app-store listing, in-app screens, purchase flow,

paywall, or documentation.

We may offer free features, paid features, subscriptions, in-app purchases,

trials, or other access options. Feature availability may depend on the App, the

platform, your device, your operating system, your country or region, your

subscription status, or third-party services required by the App.

You are responsible for testing an App before relying on it for important

events, business processes, presentations, performances, productions, or other

time-sensitive use cases.

## 3. Accounts and Access

Some Apps may work without an account. Other Apps may require an account,

internet connection, app-store account, third-party login, device permissions,

backend access, or a valid purchase or subscription.

You are responsible for keeping your account credentials, session codes, access

links, QR codes, passwords, purchase credentials, and device access secure.

Anyone with valid access details may be able to access related app features or

content.

## 4. Free Features, Paid Features, and Subscriptions

Some Apps may offer free features with limits. These limits may include, for

example, limits on usage, sessions, storage, devices, exports, customisation,

duration, content, or other app-specific features.

Paid features or subscriptions may unlock expanded limits, premium tools,

additional content, customisation options, priority features, cloud features, or

other benefits described in the App, purchase screen, paywall, or store listing

at the time of purchase.

Features and limits may differ between Apps, platforms, countries, and plans.

We may add, change, or remove features where reasonably necessary, including for

security, compatibility, maintenance, legal, platform, third-party-service, or

product reasons.

## 5. Purchases, Billing, Renewal, and Cancellation

If you purchase an App, in-app purchase, or subscription through Apple App Store

or Google Play, the purchase is processed by the relevant store provider, not

directly by us. The price, billing period, taxes, renewal terms, trial terms,

discounts, and cancellation information are shown in the store purchase flow

before you confirm the purchase.

Subscriptions may renew automatically unless cancelled before the end of the

current billing period or trial period, according to the rules of the store

where you purchased the subscription. The payment method linked to your Apple

Account, Google Account, or other store account may be charged for renewals.

You must manage or cancel subscriptions through the same store account or

provider that processed the purchase.

For Apple App Store purchases:

1. Open Settings on your iPhone or iPad.

2. Tap your name.

3. Tap Subscriptions.

4. Select the relevant subscription.

5. Tap Cancel Subscription and follow the instructions.

For Google Play purchases:

1. Open Google Play Store.

2. Go to Payments & subscriptions.

3. Select Subscriptions.

4. Select the relevant subscription.

5. Tap Cancel subscription and follow the instructions.

Uninstalling an App does not automatically cancel an active subscription. If you

cancel a subscription, you will normally keep access to paid features until the

end of the period you have already paid for, unless the store provider or

applicable law provides otherwise.

## 6. Trials, Promotions, Restore Purchases, and Price Changes

Some Apps may offer trials, introductory prices, discounts, promo codes, or

other promotions. The availability and terms of such offers are shown in the

relevant purchase flow or store listing.

If a trial converts to a paid subscription, the store purchase flow will show

the timing and price before you confirm. You are responsible for cancelling a

trial before it renews if you do not want to continue with a paid subscription.

If subscription prices change, the relevant store provider may notify you or ask

for confirmation where required by its rules or applicable law.

If an App includes restore functionality, you may use it to restore eligible

purchases made with the same Apple Account, Google Account, or other store

account. Restore availability depends on the store provider and the purchase

type.

## 7. Refunds

Refunds for purchases made through Apple App Store are handled according to

Apple’s policies and applicable law. Refund requests may be submitted through

Apple’s refund process.

Refunds for purchases made through Google Play are handled according to Google

Play’s refund policies and applicable law. Refund requests may be submitted

through Google Play’s refund process.

If you contact us about a purchase issue, include the app name, platform,

purchase date, subscription or product name, and relevant order information.

Do not send full payment card details.

## 8. Additional Terms for Apple App Store Apps

This section applies if you download, access, purchase, or subscribe to an App

through Apple App Store.

The App is licensed, not sold, to you. Subject to these Terms and Apple’s

app-store rules, we grant you a limited, non-transferable licence to use the App

on Apple-branded products that you own or control and as permitted by Apple’s

usage rules.

Apple is not responsible for providing maintenance or support for the App. We,

not Apple, are responsible for providing any support for the App as described in

the relevant app-store listing or support page.

To the extent any warranty applies by law and cannot be disclaimed, you may

notify Apple if an App downloaded from Apple App Store fails to conform to an

applicable warranty. Apple may refund the purchase price, if any, according to

Apple’s policies. To the maximum extent permitted by law, Apple has no other

warranty obligation for the App.

We, not Apple, are responsible for addressing claims relating to the App,

including product liability claims, claims that the App fails to conform to

legal or regulatory requirements, consumer protection claims, and intellectual

property infringement claims.

You represent and warrant that you are not located in a country or region that

is subject to a U.S. government embargo or designated by the U.S. government as

a „terrorist supporting“ country, and that you are not listed on any U.S.

government list of prohibited or restricted parties.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms for

Apps distributed through Apple App Store. After you accept these Terms, Apple

has the right to enforce these Terms against you as a third-party beneficiary.

If these Terms conflict with Apple’s applicable App Store terms, Apple’s terms

apply to the extent required by Apple.

## 9. Device Permissions and Third-Party Services

Some Apps may request device permissions, such as camera, notifications,

storage, network access, or other permissions needed for specific features. You

can usually manage permissions through your device settings. Some features may

not work if required permissions are disabled.

Our Apps may rely on third-party services, including Apple, Google, Firebase,

RevenueCat, cloud providers, payment providers, analytics providers, or other

service providers. These services may have their own terms, policies, privacy

notices, and availability requirements.

## 10. Acceptable Use

You agree not to misuse the Apps. You must not:

– use an App for unlawful, harmful, fraudulent, or abusive activity;

– access, modify, or disrupt data, sessions, systems, or accounts that you are

not authorised to use;

– bypass payment, subscription, access, security, or technical restrictions;

– reverse engineer, decompile, or interfere with an App except where this

cannot be prohibited by applicable law;

– overload, attack, scrape, automate, or misuse backend services;

– upload, enter, transmit, or display content that infringes rights, violates

law, or is abusive, hateful, defamatory, misleading, or harmful.

We may restrict or terminate access if we reasonably believe an App is being

misused or if required to protect users, the Apps, third-party services, legal

rights, or platform compliance.

## 11. User Content and Data

Some Apps may let you enter, upload, create, store, display, share, or transmit

content or data („User Content“). You are responsible for your User Content and

for ensuring that you have the necessary rights to use it in the App.

You keep any rights you have in your User Content. You grant us a limited right

to process, transmit, store, display, and use User Content only as needed to

operate the App, provide features you request, provide support, secure the App,

improve reliability, and comply with law.

Some User Content or app data may be temporary, local-only, synced through

backend services, or retained according to the specific App’s functionality and

privacy policy.

## 12. Privacy

Your use of the Apps is also governed by the applicable Privacy Policy. The

Privacy Policy explains what data an App collects, how it is used, and what

choices you have.

Privacy Policy: [insert your public Privacy Policy URL]

If an App has an app-specific privacy policy, that app-specific privacy policy

applies to that App.

## 13. Availability and Changes

We aim to keep the Apps reliable, but we do not guarantee that every App will

always be available, uninterrupted, error-free, or compatible with every device,

operating system version, platform, network, region, or third-party service.

We may update, modify, suspend, or discontinue an App or feature where

reasonably necessary. Some changes may be required for security, platform

requirements, app-store policy compliance, third-party-service changes, bug

fixes, legal requirements, or product improvements.

## 14. Intellectual Property

The Apps, including software, design, branding, text, graphics, user interface,

logos, and other materials, are owned by us or our licensors and are protected

by applicable intellectual property laws.

These Terms do not transfer ownership of any App to you. We grant you a limited,

non-exclusive, non-transferable, revocable licence to use each App for personal,

professional, or internal business use in accordance with these Terms, the

applicable store terms, and any app-specific rules.

## 15. Disclaimer

The Apps are provided on an „as is“ and „as available“ basis to the maximum

extent permitted by law. We do not make warranties that an App will meet every

requirement, operate without interruption, be free from errors, or be suitable

for every use case.

Nothing in these Terms limits rights that cannot be limited under applicable

consumer protection law.

## 16. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect,

incidental, special, consequential, or punitive damages, or for loss of profits,

revenue, data, goodwill, business opportunities, productions, events, or

presentations arising from or related to your use of an App.

Our total liability for claims related to an App will not exceed the amount you

paid for that App, subscription, or in-app purchase during the 12 months before

the claim, unless a higher amount is required by applicable law.

These limitations do not apply where liability cannot be limited by law,

including liability for intentional misconduct, gross negligence, injury to

life, body, or health, or mandatory consumer rights.

## 17. Termination

You may stop using an App at any time. You may cancel paid subscriptions through

the store provider that processed the purchase.

We may suspend or terminate access to an App if you violate these Terms, misuse

the App, create legal or security risk, or if we discontinue the App or a

feature.

Termination does not automatically cancel subscriptions purchased through Apple

App Store or Google Play. You must cancel subscriptions through the relevant

store account.

## 18. Governing Law

These Terms are governed by the laws applicable in the country or region where

the developer, publisher, or company listed in the relevant app-store listing is

established, unless mandatory consumer protection laws in your country provide

otherwise.

If you are a consumer, you may have rights under the mandatory laws of your

country of residence that these Terms cannot override.

## 19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we

will update the effective date above and provide notice where required by law.

Your continued use of an App after updated Terms become effective means that

you accept the updated Terms.

## 20. Contact

For questions about these Terms, purchases, subscriptions, refunds, or support,

contact us using the support email address shown in the relevant app-store

listing or on the applicable support page for the App.
