System Activity Dashboard — Terms of Use
Last updated: 15 October 2026
1. Provider and scope
These product terms describe System Activity Dashboard, shown on your Mac as System Activity, provided by Andre Sieger, trading as Niceosoft, c/o IP-Management #7773, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany. App support: niceosoft@gmail.com. Privacy contact: info@niceosoft.com. Last updated: 15 October 2026.
They explain use of the macOS app and supplement the applicable App Store terms. They do not replace mandatory consumer law or Apple’s applicable licence terms. Where Apple’s Standard End User Licence Agreement applies, it remains the app’s licence agreement; nothing here expands its permissions to collect data beyond the actual processing described in our Privacy Policy.
2. Licence, availability and purchases
Use the app on compatible Apple devices as permitted by the applicable App Store usage rules and licence. The current app requires macOS 14 or later. It does not require a Niceosoft account and does not offer in-app subscriptions. Any purchase price, availability and applicable purchase terms are those shown by Apple at the time of purchase. Apple handles the App Store transaction and its purchase-management and refund processes; statutory rights remain unaffected.
Do not unlawfully copy, redistribute or use the app, circumvent security restrictions, or infringe other people’s rights. Exceptions and permissions provided by mandatory law, including applicable interoperability rights, remain unaffected. You may stop using the app at any time; manage any local records, exports and backups you wish to remove separately.
3. What the app provides
The app displays live system-wide CPU, memory and network statistics, a live process view, locally recorded system history, comparisons between periods, CSV export and a menu-bar view. Language and recording settings are controlled on your Mac. It is a monitoring tool, not an optimisation, antivirus, security-audit or repair service. It does not control or terminate other processes.
Features depend on the statistics and permissions macOS exposes, the hardware and the periods actually recorded. Missing or protected values are shown as unavailable; they should not be interpreted as zero. No continuous recording, minimum performance improvement or recovery of deleted data is promised.
4. Interpreting measurements
CPU percentages represent the share of total available processor capacity across logical cores. Memory figures are estimates based on system statistics; they are not a memory-pressure diagnosis. Per-process memory is resident memory (RSS), which may include shared pages and must not be added as if it were exclusive memory for each app.
Network figures are byte-counter changes on active Wi-Fi/Ethernet interfaces, including local-network traffic. They are not an internet speed test, an internet-provider billing meter or per-app network attribution. VPN and virtual interfaces are not separately added. Sampling intervals, counter changes, sleep, app termination and unavailable data affect the results.
History averages are weighted by recorded duration. Comparisons should be assessed together with their recording coverage. Lower values do not necessarily indicate better performance. Use appropriate independent checks before making decisions with material consequences; the app is not intended as a safety-critical or regulatory measurement system.
5. Recording, power use and your data
Closing the main window leaves the app running in the menu bar. Quitting stops recording. Pauses and sleep create gaps rather than invented measurements. The keep-awake option is initially enabled during recording and can be switched off in Settings. It can increase battery drain and energy consumption. Display sleep and locking remain possible; manual sleep, closing a laptop lid or system conditions may interrupt operation.
History is stored locally, with a selectable 7-, 30- or 90-day retention period. Reducing retention or deleting history can permanently remove records. Delete all history also pauses recording. Existing exports, settings and separate backups are not removed by that action. Keep your own backups where needed and handle exported data carefully. See the Privacy Policy for details of local storage and voluntary support disclosures.
6. Updates and support
Support is available at niceosoft@gmail.com. Describe the issue and your macOS/app versions; do not send passwords or unnecessary private files. There is no separate service-level agreement or guaranteed response time. Rights to support, remedies and updates required by applicable law remain unaffected.
Updates may fix defects or adapt the app to macOS changes. We do not promise a particular future feature or perpetual compatibility with every future macOS version. Material changes are subject to the applicable purchase terms and law; merely updating this page does not retroactively remove existing rights.
7. Warranty, liability and mandatory rights
Your statutory rights concerning defects, conformity, digital products, required updates, refunds and remedies are not excluded or reduced by these terms. Any additional warranty must be expressly stated; the app’s measurements should be assessed with the technical limitations described above.
Nothing here excludes or limits liability that cannot lawfully be excluded or limited, including liability for intent, gross negligence, injury to life, body or health, fraudulently concealed defects, an expressly assumed guarantee, or mandatory product liability. These terms do not impose a fixed damages cap or require you to waive mandatory consumer protections.
8. Applicable rules and contact
The applicable App Store licence and purchase terms, together with mandatory law, govern the relevant licence and transaction. These product terms do not impose an exclusive court or deprive consumers of protections available under the mandatory law of their country of habitual residence. If a provision is unenforceable, the remaining lawful provisions and applicable statutory rules continue to apply.
For questions about these terms or the app, contact niceosoft@gmail.com. Provider information is available in the Niceosoft legal notice. The linked Privacy Policy explains how local app data, support correspondence and website visits are handled.
